Terms of use
The agreement governing use of the Service.
Parties and definitions
These terms constitute an agreement between Antonios Karvelas, Dimarhou Skoura, 34100 Chalkida, Greece (the “Operator”), and any person who registers an account on or otherwise uses the website at articulivitales.com (the “User”). The website and the functionality it provides are together referred to as the “Service”. The Operator may be contacted at ant.karvelas@pm.me.
Registration of an account constitutes acceptance of these terms. A person who does not accept them should not register an account. The Service is provided free of charge and on a non-commercial basis.
Scope of the Service
The Service comprises a reading list derived from the Wikipedia Vital Articles project, the text of the listed articles presented for reading, facilities for saving passages and recording notes, and an assessment in respect of each article which records a pass where the requisite number of questions is answered correctly. No undertaking is given that any particular article, assessment or feature will remain available, or that the number of correct answers required for a pass will remain as presently set.
Accounts
- The User is responsible for maintaining the confidentiality of the account password, which should not be one used in respect of any other service. Activity conducted through an account is attributed to the account holder.
- Supply of an email address is optional. Where no address has been supplied, a forgotten password cannot be reset and access to the account will be irrecoverably lost. The User accepts that consequence in electing not to supply an address.
- The User may delete the account at any time by means of the account page. Deletion takes immediate effect, is irreversible, and erases all associated records.
- Where the User is below the age of 15, the account should be established with the involvement of a holder of parental responsibility.
User content
Bookmarks and notes recorded by the User remain the property of the User. The Operator asserts no ownership of and claims no licence over such material, and does not read, analyse, publish, disclose or use it for the training of any system. Such material is accessible to the User and, as a necessary incident of administration of the server, to the Operator, as described in the privacy policy.
A report submitted in respect of a defective assessment question constitutes a request that the report be read and acted upon, and is processed accordingly.
Permitted and prohibited use
- The User shall not attack, probe or attempt to gain unauthorised access to the server or to the accounts of other users.
- The User shall not subject the Service to automated requests at a volume liable to impair its operation, and shall not extract the assessment question banks in bulk.
- The User shall not use the notes facility to store or transmit unlawful material.
- Accounts used in contravention of this clause may be suspended without notice.
- Nothing in this clause restricts the automated retrieval of article text for personal use, or the reproduction of that text in accordance with the licence under which it is provided. The terms applicable to article text are set out on the licensing page.
Status of assessments
A pass recorded by the Service is not a qualification, certificate, credit, academic award or credential of any description. It records only that, on a given occasion, the requisite number of a set of five multiple-choice questions was answered correctly. No representation to the contrary should be made to any third party.
Accuracy and absence of verification
- Article text is reproduced from Wikipedia as it stood at the time of retrieval. It is not verified, corrected or endorsed by the Operator, and may be incomplete, outdated, disputed or subject to vandalism.
- Assessment questions are generated by a language model and reviewed manually. That review does not identify every defect, and questions may be ambiguous or incorrect. A facility for reporting defective questions is provided beneath each question.
- No content on the Service constitutes professional advice of any kind, including medical, legal or financial advice, and no reliance should be placed upon it as such.
Availability
The Service operates on a single rented server and is maintained by one individual. No level of availability is warranted. The Service may be unavailable, may perform slowly, and may be discontinued. Where discontinuation is intended, notice will be given on the Service sufficiently in advance to permit export of User data.
No warranty is given as to the retention or integrity of backups. The export facility is provided so that the User may retain an independent copy of the User's data.
Limitation of liability
- The Service is provided on an “as is” basis, without warranty of any kind, whether express or implied, including as to merchantability, fitness for a particular purpose or accuracy.
- To the fullest extent permitted by law, the Operator shall not be liable for any loss or damage arising from use of the Service, from reliance on any content presented by it, or from its unavailability or from loss of data.
- Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited. The statutory rights of a User acting as a consumer are unaffected.
Independent instances of the software
The software underlying the Service is made available under the MIT licence. These terms apply solely to the Service as operated by the Operator. An instance operated by any other person is that person's sole responsibility, and is governed by whatever terms that person establishes.
Amendment and termination
These terms may be amended. Notice of an amendment materially affecting the User will be given on the Service before the amendment takes effect, and continued use of the account thereafter constitutes acceptance. A User who does not accept an amendment may delete the account.
Governing law and jurisdiction
These terms are governed by Greek law, and the courts of Greece shall have jurisdiction. Where the User is a consumer resident in another Member State of the European Union, this clause does not deprive the User of the protection afforded by the mandatory provisions of the law of that State, nor of any right to bring proceedings before its courts.
